CA 28 March 1994. The landlords (S) served notice to quit under Agricultural Holdings Act 1986 Sch 3 Case D following the tenants` (B) payment of rent less the amount of the drainage rate. Held that B did not have any right under Land Drainage Act 1976 s72(5)(d) to deduct the drainage rate before the drainage rate payment had been made. The Case D notice was valid.
