In Sefton Holdings Ltd v Cairns CA 2 November 1987 it was held that whether a person was entitled to succeed to a statutory tenancy on the death of the first successor of the original protected or statutory tenant, depended on that person being a member of the deceased`s family and not merely living as a memebr of the family or being a member of the household.
