CA 10 June 1994. On 22 February 1989 V issued a writ claiming forfeiture of a headlease, for 64 years from 24 June 1980, held by H of a house in Chelsea, for breach of covenant. Four flats in the house were subject to underleases granted in excess of sixty years at ground rents. Judgment to V ordering payment of mesne profits, assessed by reference to the letting value of the house. H appealed, contending house was sublet as flats on long leases. Appeal dismissed.
