QBD 21 July 1989. Action by plaintiff (L) against defendant (B) for damages for negligence in carrying out a mortgage valuation . After purchase, whilst carrying out repairs the property was found to be in a worse physical state than indicated in the valuation report. It was held that B had failed in his duty of care and it was accepted that L would not have purchased the property if the problems had been indicated in report. Defines the requirements of a valuation report . L awarded damages with costs.
