"Kumah and another v Osbornes" QBD 17 January 1997. K`s solicitors instructed to make agreement to repay mortgage arrears in return for cancellation of eviction order. Solicitor incorrectly assumed K could pay outstanding arrears in full and mortgagor took possession. K claimed the solicitor had been negligent in not reducing agreement to writing. Claim dismissed.
