In Heinemann v Cooper , CA 4 March 1987,it was held that where the purchaser of the lease of a flat had been induced to make the contract by a misrepresentation as to the level of the service charge for the flat , he was entitled to recover damages for the diminution in the value of the property attributable to the higher service charge.
