In Quietlynn Ltd v Plymouth City Council ; Portsmouth City Council v Quietlynn Ltd and Another; Quietlynn Ltd v Oldham Borough Council , QBD 5 March 1987, it was held that on a prosecution alleging use of premises as a sex establishment without a licence , the court could not investigate and determine the validity of the licensing authority`s refusal to grant a licence.
