In Citibank Trust v Ayivor and Another , ChD 11 March 1987, it was held that where a bank has a right to possession of mortgaged property the court cannot stay delivery on the ground only that the mortgagor is counterclaiming against the bank in respect of its having allegedly misled him into buying defective property .
