QBD 12 December 1989 Application under Town and Country Planning Act 1971 s245 by Harrow LBC (H) to quash an inspector`s decision relating to two appeals made by Harrow School against H`s refusal s to grant conservation area consent to demolition of buildings and planning permission for the erection of 21 houses and a theatre . The inspector had allowed both appeals. The decision was attacked on the grounds that the inspector had failed to pay special attention to conservation area implications under Town and County Planning Act 1971 s277(8) .QBD held, dismissing the application, that it should appear from the inspector`s decision letter or report as a whole, that he had paid special attention to s277(8). In this case it was clear from the letter as a whole that the inspector had done so and the application would be refused.
