"Fordgate Bingley Ltd v Argyll Stores Ltd" ChD 25 February 1994. Rent review terms required the appointment of a surveyor four months before review, or RICS nomination three months before, in order for the landlord to pursue its claim. The nominated sureyor notified the parties of his role after the specified date and so the landlord applied for an extension of time. Leave refused.
