In Kelly v Norwich Union Fire and Life Insurance Ltd , CA 5 April 1989, a homeowner`s appeal against the decision in favour of the insurers has been dismissed. It was held that the insured house owner was not entitled to be indemnified for loss or damage which occurred during the term of the policy if the peril causing the loss or damage occurred before the policy began.
