In "Estates Gazette Ltd v Benjamin Restaurants Ltd and another" CA 20 May 1994 by a lease dated January 17 1977 an appeal was allowed and the judgment restored where there was a covenant to pay rent which was in arrears. The issue arose as to whether the covenant was limited to a period during which lease was vested in the assignee.
