In "O`Sullivan v Barnett and another" CA 19 May 1994, tenant`s appeal was dismissed where a landlord was sharing accommodation with a tenant and in the process of moving into other premises. The tenant took up occupation before the landlord and the issue arose as to whether the landlord was occupying the same or another dwellinghouse for purposes of protected tenancy.
