In "R v Northavon DC, ex parte Palmer", CA 13 July 1995, it was held that breaches of a housing authority`s duties under the Housing Act 1985 ss 62 and 63 to process an application made under part 3 of the Act and to provide temporary accommodation did not give rise to a private law action for damages. Appeal dismissed.
