CA 25 July 1990. Appeal by tenants Romulus Trading Co Ltd (R) against a cc decision refusing to amend the form of a preliminary issue ordered by the master in proceedings under Landlord and Tenant Act 1954 between R and landlord Henry Smith Charity Trustees (H). Second occasion this case had been referred to CA - Romulus Trading Co Ltd v Trustees of Henry Smith`s Charity CA 30 November 1989 (Abstract 43224). At the second CA hearing, the cc decision was upheld. Appeal dismissed.
