CA 28 November 1991. Appeal by tenant King (K) against cc decision which determined that K`s liability to pay the service charge survived by reason of Landlord and Tenant Act 1954 s10(1) . Under a protected tenancy agreement K was under covenant in underlease to pay service charge. On expiry of the underlease and its replacement by a statutory tenancy , K disputed liability to continue paying service charge. CA upheld cc decision. Appeal dismissed,
