In Thrasyvoulou v SoS Environment and Another : Oliver and Others v SoS Environment and Another HL 4 December 1989, a decision of the Environment Secretary allowing an appeal against an enforcement notice contained in the Town & Country Planning Act 1971 , as substituted by the Local Government Planning Act 1981 , was capable of giving rise to an issue estoppel.
