CA 7 November 1990. The CA overruled the cc decision to allow that the Rent Act 1977 schedule 1 para 3 had been fulfilled by the appellant, who therefore gained a statutory tenancy by succession . The fact that the original tenant had been absent temporarily for part of the six months before her death did not disqualify the appellant.
