A brief commentary draws attention to the significance of issue estoppel for rent reviews displayed by the case Arnold and others v National Westminster Bank . An aggrieved party is now given leave to return to court on issues previously decided, where subsequent judgments shew the earlier decision to be incorrect and where its maintenance would prolong injustice.
