CA 25 October 1990. A dispute over recovery of rent by guarantors once the tenant had ceased trading. The first and second defendants appealed, claiming they had been asked for rent by the third defendant after been led to believe their liability was limited to two years, following the issue of a break notice . The judge, in upholding the appeal, said there was an arguable defence that an estoppel by convention had arisen.
