Greenwich LBC v Parker

Greenwich LBC v Parker - 1991 - Legal Action May 1991, 14-15(1) .

Woolwich CC 3 January 1991. P was tenant of a house owned by the council (G) on which there was a long history of rent arrears . G claimed possession on the grounds of arrears of £388.13 plus £68.10 in respect of water services . D did not defend the action but the question arose as to whether G is entitled to collect and sue for money owing to the water authority and whether money owing to in respect water services can be treated as rent. Water Act 1972 s32 provided for agreement to be entered into for the collection of water charges by local authorities . It was held that ` weekly rent ` on the property included basic rent, rates and other charges and therefore G was entitled to sue for water charges . Another case is linked to this Southwark LBC v Jones Lambeth CC 2 November 1990 (unreported).
