In the Scottish case Gordon District Council v Wimpey Homes Holdings Ltd Outer House of the Court of Sessions 7 June 1988 it was held that the purchasers of two plots of land, acted reasonably in determining that the planning permission granted was not to their satisfaction and were entitled to treat the contract as at an end.
