In "Ward-Lee v Lineham" CA 9 February 1993, it was held that where an application for a new tenancy under Landlord and Tenant Act 1954 s24 had not been served on the landlord within time and where no application had been made for an extension of time, the county court could excercise its discretion to extend time.
