In R v Kuxhaus CA 19 February 1988 it was held that the " final determination by the SOS Environment of an appeal to him against an enforcement notice in accordance with Town and Country Planning Act 1971 s88 (10) could not be known to have occurred until after the appeal was withdrawn or determination of appeals under s246 to the High Court, Court of Appeal and the House of Lords.
