In Greenwich London Borough Council v Powell and Another CA 23 February 1988 it was held that in determining whether a site was "a caravan site providing accommodation for gypsies " and therefore exempt from the definition of a "protected site", it was necessary to determine whether the land was occupied at a material time as a caravan site providing accommodation on a continuing basis for gypsies.
