In "Muir Housing Association Ltd v Thornley and another" CA 6 October 1992, the landlord`s appeal against the CC`s decision was allowed on the grounds that the tenant in subletting a dwelling house was in breach of his secure tenancy agreement. Therefore, the landlord was entitled to refuse to convey estate in house even though the sale was already agreed.
