In "SOS for Environment v General Education Ltd" CA 8 October 1992, the CA in allowing the appeal by the SOS accepted that the Inspector had taken into account material consideration in refusing planning permission for change of use from residential to offices even though permission for a language school had been granted in 1981, on the basis that its need at this time outweighed its benefits.
