In Smith v Eric S.Bush CA 13 March 1987 it was held that where a surveyor reports to a building society on the value of a property at the lower end of the market and where it was likely that the purchaser would rely on the report, it would not be "fair and reasonable" under the Unfair Contracts Terms Act 1977 to rely on a clause excluding liability for negligence .
