CA 20 November 1990. The landlord, who was alleged to have given notice to quit to tenants in rent arrears, let the flat to a new tenants, assuming the first tenants to have left. The first tenants appealed for restoration to the flat. Acknowledging that the landlord acted in good faith, not knowingly contravening the Protection from Eviction Act 1977, and that the tenants could not be reinstated, the court declared that the appellants were entitled to occupy the flat and they could apply to add the new tenant as a party to the proceedings for possession.
