In McCarthy v Bence , CA 15 December 1989, the appeal was dismissed on the grounds that the respondent had no intention of granting exclusive occupation ; the arrangement was a joint venture although not a partnership . The licence to the appellant to use the land was not caught by Agricultural Holdings Act 1986 s2 as there was no exclusive occupation.
