In Bruno Zornow (Builders) Ltd v Beechcroft Developments Ltd , 28 July 1989, a contractor made an application to the High Court for summary judgement, pursuant to Order 14 of the Rules of the Supreme Court and alternatively for an interim payment under Order 29 in respect of monies payable under two interim certificates issued by the architects under a building contract , however the building owner said that he was entitled to deduct liquidated damages for delay . The case was held in favour of the plaintiff on the grounds that the calculation for liquidated damages was unfounded.
