In "Holmes & another v Bradford MCC" QBD 11 May 1994 it emerged that an owner of land could not be properly charged under Town and Country Planning Act 1990 s179(4), with a failure to comply with an enforcement notice. Held, the two owners of land each be fined £8,000 with costs, and that an appeal by them be allowed.
