QBD 25 January 1991. An action against surveyors (T) alleging negligence or breach of contract in carrying out a structural survey of a house in London SW1. On commencement of refurbishment work, the property was found to be infested by dry rot, although nothing had been mentioned in the survey report. The remedial work required the whole of the kitchen to be stripped out. At the trial there was a conflict of expert evidence. The judge accepted that surveyor who had carried out the survey on behalf of T, had not been aware of the dry rot. He was not satisfied that T had failed to take the standard of care demanded of the ordinary skilled surveyor carrying out a structural survey. Action dismissed with costs.
