Following a refusal to allow the felling of a tree under a tree preservation order, the claimant commissioned a report from an arboricultural consultant on the effect of the tree on the foundations of the house. A claim for compensation for loss equal to the cost of this report was successful under Town and Country Planning Act 1971 s174.
