QBD 13 November 1991. Developers apealed under Town and Country Planning Act 1971 s245 against refusal of planning permission for a site within the green belt. It was held in the present action that the inspector at the planning inquiry acted correctly in refusing to consider submissions that the site was wrongly designated as green belt even though he was aware that this designation was to be challenged in the HC.
