In Shanning International Ltd v George Wimpey International Ltd CA 8 September 1988 it was held that on an application for an interim payment , the court had first to satisfy itself that the plaintiff would succeed in obtaining judgment for a substantial sum and only then proceed to decide whether as a matter of discretion an interim payment should be ordered.
