In G Garbutt and Sons Ltd v SOS for the Environment and Another QBD 15 June 1988 it was held that the decision of the SOS refusing planning permission for stationing a caravan on a site intended for use as a market garden , should be quashed because the planning inspector had not observed the rules of procedural fairness.
