Sheriff Court of Glasgow and Strathkelvin at Glasgow, 2 February 1995. LP raised an action for damages against WFS, chartered surveyors, claiming that a property valuation had been negligently carried out by the defenders as a result of which the pursuers had sustained loss and damage. WFS argued that the loss was due to the fault of LP or at least there was contributory negligence on their part. Held, LP`s preliminary please sustained and proof before answer allowed.
