In R v Commission for the New Towns ex parte Tomkins and another QBD 16 February 1988 it was held that the Commission in disposing of land compulsorily purchased for a new town , was entitled to decide that the only way of finding out the best price was to go out to tender and should have regard to the DOE `s guidelines on disposal of land, but was not bound by them.
