"R v MAFF ex parte Cox" QBD 12 February 1993 concerned an application for judicial review by dairy farmer of MAFF`s intention to rescind the transfer of her dairy quota. On examining EC Regulation 1371/84 article 5 as amended by 1034/85 and the Dairy Produce Quota Regulations 1986, the HC judge interpreted the provisions as requiring the transferee to be operating the holding before becoming entitled to the transfer of the dairy quota.
