In Holding Management Ltd v Property Holding and Investment Trust Plc and others QBD 16 November 1987 it was held that a maintenance trustee who managed a block of flats, and held a maintenance fund provided by contributions from tenants was acting in its capacity of agent of the landlord rather than as trustee for the tenants in legal proceedings to enforce the tenants repairing covenant at the cost of the fund.
