"J Davy Ltd v Guy Salmon (Services) Ltd" QBD 9 June 1992. The tenant, although failing to comply with Fire and Civil Defence Authority conditions for a licence to keep petroleum spirit on the premises, was not in breach of covenant and therefore not liable for the cost of putting in order the premises for the landlord to renew the licence, so the court held.
