"Chamberlaine v Scally" CA 19 June 1992. The tenant had moved out of her accommodation but left possessions there and retained the key, visiting weekly. Her partner, not a tenant although paying the rent, remained in the flat. The CA held that this behaviour was not unequivocal evidence of surrender and allowed the appeal against the cc order for possession.
