CA 11 January 1993. The appellant` predecessor, having donated common land to the NT in 1937, reserved three rights of way for vehicles. In more recent times, the NT claimed that two of the rights were extinguished and registered a caution under the Land Charges Act 1972 s5. W commenced proceedings to have the caution vacated but lost the action and also their subsequent appeal.
