ChD 26 November 1992. S agreed to purchase a leasehold property from A and entered a subcontract to simultaneously sell it to a third party. A, on discovering this arrangement, refused to complete, and a chain of notices, claims and counter-claims ensued between the three parties involved. S took action to recover losses arising from the secondary sale`s abandonment` caused by A`s alleged breach of contract. As there had been no notice of S`s intentions, or circumstances pointing clearly to a subcontract, the claim for damages failed.
