In D & F Estates Ltd and Others v Church Commissioners for England and Others , CA 12 February 1987, it was held that although a contractor owes a duty of care to future occupiers of a building, liability does not extend to owners who never take up occupation; and where defective work is carried out by a negligent subcontractor , a main contractor owes no liability in tort.
