QBD 4 March 1991. Appeal by Council against inspector`s decision to allow appeal against Council`s refusal to grant planning permission for the change of use of a detached garage to a granny annexe. Inspector held that the use of a building as a residential annexe to an existing building does not involve a material change of use. On appeal, QBD held that the garage conversion was in the same planning unit as the dwelling and no material use had taken place. Appeal accordingly dismissed.
