QBD 23 July 1991. Planning applications for certain changes to a development, which already had planning permission was granted after the council received legal advice in a closed session. The claim that the legal advice, which was that since this second application was not materially different from the development permitted previously, the council would be unlikely to win an appeal, was not a material consideration , was dismissed.
