QBD 26 July 1991. The council was not found to have been acting unreasonably in auction ing property after negotiating the leasehold or freehold with the appellants since all negotiations were subject to contract . Also the council was not acting contrary to Race Relations Act 1976 s71 in wanting to grant a long lease in preference to the freehold so as to enforce user covenants to restrict use to religious rather than community use .
