The HL ruling on Linden Gardens Trust v Lenesta Sludge Disposals is imminent. It is expected that the decision will be that developers cannot transfer rights to make claims against a contractor; the contractor`s consent is required. The relevant section of JCT 1963 clause 17(1) may now not be amended in the light of such a decision.
